Terms of Use
These Terms of Use (“Terms”) govern your access to and use of trch.com and the pages, content and forms on it (the “Site”), together with any client-facing system Torch Group, LLC (“Torch Group”, “TRCH”, “we”, “us” or “our”) gives you access to in connection with an engagement, including the reporting environment at analytics.trch.com (each a “Client System”).
Please read these Terms carefully. By using the Site, you agree to be bound by them. If you do not agree, please do not use the Site. Our Privacy Policy explains what we collect and why, and forms part of these Terms.

Acceptance of These Terms
These Terms form a binding agreement between you and Torch Group. You accept them by using the Site or by signing in to a Client System. If you are using the Site or a Client System on behalf of a company, you confirm that you have authority to accept these Terms for that company.
Who We Are
Torch Group, LLC is a strategic marketing consultancy based in Boca Raton, Florida. The Site describes our services and the work we have done. Nothing on it is an offer, and nothing on it creates a client relationship. A client relationship begins only when both parties sign a written agreement.
Using This Site
You may read, print and share the pages of this Site for your own business or personal reference. We ask that you use the Site lawfully and in a way that does not interfere with anyone else’s use of it.
Restrictions
You agree not to:
- Copy, republish or resell substantial parts of the Site’s content as your own, or use it to train a model or build a competing service.
- Scrape, crawl, harvest or otherwise extract content or contact information other than by normal browsing or search-engine indexing.
- Attempt to gain unauthorized access to the Site, a Client System, or any account, server or network connected to either.
- Introduce malware, attempt to disrupt or overload the Site, or probe or test its security without our written permission.
- Use a form on the Site to send unsolicited commercial messages, or to submit anything unlawful, misleading or infringing.
- Remove or obscure any copyright, trademark or other proprietary notice.
Client Access to TRCH Systems
During an engagement we may give you access to a Client System so you can see reporting, dashboards or working material relating to your account. That access is provided as part of the engagement and on the following basis.
- Access is granted to named individuals. Credentials are personal to you and may not be shared, transferred or used by anyone else.
- You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly if you believe an account has been compromised.
- Access is limited to material relating to your own engagement, and is provided for your internal business use only.
- We may change, suspend or withdraw access at any time, and access ends when the engagement ends unless we agree otherwise in writing.
- Where a Client System is provided by a third party, that provider’s terms also apply to your use of it.
Anything in a written agreement between us and your company, such as a master services agreement or statement of work, takes precedence over these Terms to the extent the two conflict.
Reporting, Analytics and Measurement
Reporting we provide, whether on the Site, in a Client System, or in a document, is assembled from third-party analytics, advertising and CRM platforms, including tools such as Google Analytics, Google Search Console, advertising platforms and marketing automation systems. Those platforms model, sample, estimate and de-duplicate data in their own ways, they apply their own attribution rules, and they revise historical figures from time to time.
Figures we present are therefore directional, not audited. They are provided for marketing decision-making and should not be relied on as a system of record, or used for financial reporting, statutory reporting, valuation, or any other purpose that requires audited data. Where a number matters, check it against your own source of truth.
We do not warrant the accuracy, completeness or continued availability of any third-party platform or of the data it returns, and we are not responsible for a platform changing its methodology, its terms or its access.
The Site itself uses cookies and similar technologies for analytics and, where enabled, advertising measurement. What we collect and how to control it is described in our Privacy Policy.
Information You Send Us
If you send us a message through a form on this Site, you are asking us to contact you and you confirm that the information you give us is accurate. Please do not send confidential, regulated or sensitive information through a web form. We handle what you send in line with our Privacy Policy.
If you send us feedback, ideas or suggestions about our services or this Site, we may use them without restriction and without owing you anything for them.
Our Content and Marks
The Site, including its text, design, layout, code, graphics and the selection and arrangement of its content, is owned by Torch Group or its licensors and is protected by intellectual property laws. These Terms grant you no licence to our name, logo or brand, and all rights not expressly granted are reserved.
Client Names, Logos and Testimonials
Client names, logos and marks shown on this Site remain the property of their respective owners and are used to identify work we have done, with permission. Their appearance does not imply that those companies endorse, sponsor or are affiliated with anything else on this Site. Reviews and testimonials are the words of the people named and are published with their permission. They describe the results of a particular engagement and are not a promise of the same result for anyone else.
If you are named on this Site and would like a quote, logo or reference removed, contact us and we will remove it.
Third-Party Links and Services
The Site links to sites and services we do not control, including client websites, review platforms and scheduling tools. We provide those links for convenience. We are not responsible for the content, availability or practices of any third-party site or service, and your use of one is governed by its own terms and privacy policy.
Availability and Changes
We may change, suspend or discontinue any part of the Site or a Client System at any time, with or without notice, including features, content and access. We do not guarantee that the Site or a Client System will be uninterrupted, timely, secure or error-free.
Disclaimer of Warranties
The Site, any Client System, and all content and reporting made available through them are provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, Torch Group disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site or any reporting will be accurate, complete, current or reliable, or that any defect will be corrected.
Nothing on this Site is legal, financial, tax or investment advice.
Limitation of Liability
To the fullest extent permitted by law, Torch Group and its officers, members, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of or inability to use the Site or a Client System, whether based in contract, tort, negligence, strict liability or otherwise, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to these Terms, the Site, or any Client System will not exceed one hundred US dollars (US$100), except where a written agreement between us and your company provides otherwise, in which case that agreement governs.
Indemnification
You agree to indemnify, defend and hold harmless Torch Group and its officers, members, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Site or a Client System, your violation of these Terms, or your violation of any rights of a third party.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms, the Site or a Client System will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time for operational, legal or regulatory reasons, or to reflect changes to the Site or to a Client System. The updated Terms will be posted on this page with a new date. Your continued use after the updated Terms are posted constitutes your acceptance of them.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
